There are a couple of reasons why your NRI PAN might have become inoperative even though Aadhaar linking isn’t mandatory for NRIs:

  1. Residential Status Discrepancy: The Income Tax Department (ITD) might have your residential status listed as “resident” in their records. This can happen if you haven’t:
    • Filed an ITR in the past three assessment years.
    • Informed your Jurisdictional Assessing Officer (JAO) about your NRI status.
  2. System Error: It’s also possible there might be a system error with the ITD records.

Here’s what you can do to get your NRI PAN operative again:

  • Contact your JAO: The JAO is the Income Tax Department officer designated to handle your area. You can find your JAO’s details on the Income Tax Department’s e-filing portal using the “Know Your AO” option [Income Tax Department India].
  • Submit Documents: Once you have your JAO’s details, reach out to them and explain the situation. You’ll likely need to submit documents proving your NRI status, such as:
    • Passport with an NRI visa stamp
    • PIO/OCI card (if applicable)
    • Proof of foreign residence (utility bills, rental agreement etc.)
  • Alternatively, e-file an ITR: While not mandatory for NRIs, you can still file an ITR to rectify your residential status with the ITD. However, there might be specific tax implications depending on your income sources in India.
